THIS NOTICE DESCRIBES HOW HEALTH INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
This Notice explains how health information about you may be used and disclosed, your rights regarding that information, and our responsibilities for protecting it. This Notice applies to health information maintained by Seed & Sow PLLC in connection with healthcare services. We are required by law to protect the privacy and security of protected health information (PHI), provide you with this Notice, follow the Notice currently in effect, and notify you following a breach of unsecured PHI when required by law.
Your Rights
You have rights regarding your health information. Subject to applicable law, these include the right to:
Inspect or obtain an electronic or paper copy of health information maintained about you, with limited exceptions such as separately maintained psychotherapy notes;
Ask us to correct or amend information you believe is incorrect or incomplete. We may deny a request in certain circumstances, but we will provide an explanation as required by law;
Ask us to communicate with you in a particular way or at a particular location;
Ask us to limit certain uses or disclosures. We are not required to agree to every request, but we must agree to certain restrictions involving services paid in full out of pocket when the law requires it;
Receive an accounting of certain disclosures of your health information;
Receive a paper copy of this Notice, even if you received it electronically; and
File a privacy complaint without retaliation.
How We May Use and Share Your Information
HIPAA and other laws allow us to use or disclose PHI in certain circumstances without obtaining a separate authorization. We use or disclose only the information permitted for the purpose involved and apply the minimum-necessary standard when it is required.
Treatment
We may use or share information to provide, coordinate, or manage your care, including consultation or coordination with other healthcare professionals when permitted.
Payment
We may use or share information to bill and collect payment from you, a health plan, or another responsible payer.
Health Care Operations
We may use or share information for practice operations such as scheduling, quality improvement, clinical supervision, compliance, record keeping, and other activities necessary to operate the practice.
Other Uses or Disclosures Permitted or Required by Law
We may use or disclose PHI without your authorization when federal or Texas law permits or requires it. Examples can include certain public-health or safety activities, reporting abuse or neglect, health oversight, workers' compensation, certain law-enforcement activities, coroners or medical examiners, and judicial or administrative proceedings. The exact rules depend on the circumstances, and we will follow applicable confidentiality protections.
Family, Friends, and Others Involved in Your Care
When permitted by law, we may share information relevant to your care or payment with a person you identify as involved in your care. We will consider your preferences and objections as required by law.
Uses That Generally Require Your Written Authorization
Uses or disclosures not otherwise permitted by law generally require your written authorization. If we maintain psychotherapy notes as that term is specifically defined by HIPAA, most uses and disclosures of those notes require your written authorization, except where HIPAA permits or requires otherwise. Most uses of PHI for marketing and the sale of PHI also require authorization, subject to legal exceptions. You may revoke an authorization in writing, except to the extent we have already acted in reliance on it.
Substance Use Disorder Records
Certain substance use disorder treatment records have additional privacy protections under federal law (42 CFR Part 2). If these protections apply to information we maintain, we will follow the additional confidentiality requirements required by law. These protections may also limit when these records can be used or disclosed in legal or governmental proceedings against you.
Our Responsibilities
We are required to maintain the privacy and security of your PHI.
We will notify you if a breach occurs that may have compromised the privacy or security of unsecured PHI, when notification is required by law.
We must follow the privacy practices described in the Notice currently in effect.
We may change this Notice and make the revised Notice effective for PHI we already maintain as well as information we receive in the future. The current Notice will be available upon request, at the practice, and on our website.
Access, Amendments, and Other Requests
To exercise a privacy right, request access to records, or request an amendment, contact Seed & Sow PLLC at Clair@seed-sow.com or 254-595-5317. We will respond within the time and manner required by applicable law. Any permitted charge for copies will be limited to amounts allowed by law.
Privacy Complaints
If you believe your privacy rights have been violated, you may contact Seed & Sow PLLC using the information above. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights. You will not be retaliated against for filing a complaint or exercising a privacy right.

The Texas Behavioral Health Executive Council investigates and prosecutes professional misconduct committed by marriage and family therapists, professional counselors, psychologists, psychological associates, social workers, and licensed specialists in school psychology.
